Terms & Conditions
1. These terms and conditions include information on challenge entry, including information on how to participate and prize details (Promotion Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Promotion Terms.
2. The promoter is the Young Men’s Christian Association of Sydney (ABN 28 067 150 010, CFN/21379) of 25 Argyle Street, Parramatta, New South Wales 2150 (Promoter).
3. This offer only applies to the use of health and fitness equipment at participating facilities and includes pool facilities (where applicable). The offer is subject to facility offerings and availability per centre. Exclusions include all Y programs i.e. swimming lessons, gymnastics, personal training and/or other educational or recreation programs.
4. The challenge starts on Monday 13 May 2024 and concludes Sunday 23 June 2024.
5. By participating in the Y NSW 6WC at The Hawkesbury Oasis, you agree to be bound by any terms and conditions applicable to the participating facility.
6. The 6WC registration fee is non-transferable, is not redeemable or exchangeable for cash and may not be shared.
7. All participants must join the closed Facebook group prior to challenge start date to ensure they have full access to all content throughout the challenge. Failure to join the group will limit the content a user will have access to.
8. Exclusive branded Hoodie will be provided during the challenge. Sizes will need to be provided to site when completing your registration to ensure you receive the correct item.
9. All intellectual property and related material (the "Intellectual Property") that is developed or produced from the Y NSW & Informed Health, will remain the property of The Y NSW & Informed Health. The Client is granted a non-exclusive limited-use licence of this Intellectual Property and agrees not to share or distribute content external to the challenge.
ELIGIBILITY TO ENTER
10. Entry in fitness challenge is open to anyone:
11. Aged 18 years and over.
12. Non-members will pay $240 and be granted access to the 6WC + 6 weeks facility access. They will also have access to the fitness challenge closed Facebook group and all challenge related content and additional services.
13. Current Fitness Members will pay $140.00 and will be granted access to the fitness challenge closed Facebook group and all challenge related content and additional services.
14. A pre-challenge health questionnaire will be required from all participants to ensure this challenge is suitable.
15. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.
16. Any participant who, in the opinion of the Promoter, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to enter or to win.
17. Management, employees, directors and contractors of the Promoter, its related bodies corporate and other agencies, firms or companies associated with the Promotion (including the supplier of any Prize) and at the promoters discretion includes; A spouse, de-facto spouse, parent, guardian, child or sibling of any Excluded Person on a non-financial membership are able to participate, however are excluded from any prize draws or associated prizes.
18. Incomplete, illegible, indecipherable, or incorrect entries may be excluded by the Promoter, in its absolute discretion, from eligibility to win.
19. The Promoter may, in its absolute discretion, disqualify entries in the event of non-compliance with these Promotion Terms.
THE JUDGING PROCESS AND CLAIMING PRIZES
20. The prize winners will be determined by the health and fitness coordinator based on the percentage of body fat lost results from the initial body composition scan to the final body composition scan once all challenge participants have completed their final scan. All prize winners will be notified by telephone and email.
21. The first prize is a $500 gift card. This prize will be awarded to the participant with the highest percentage of body fat lost.
22. The second prize is three months free membership at the Y Hawkesbury Oasis. This prize will be awarded to the participant with the second highest percentage of body fat lost.
23. The third prize is three free personal training sessions to be redeemed at the Y Hawkesbury Oasis. The times and days available to redeem these sessions is subject to availability. This prize will be awarded to the participant with the third highest percentage of body fat lost.
24. The prize winners will be announced externally on Friday 28 June 2024 at 10.00am.
25. To claim the Major Prize, the winner must:
a) Have been present for relevant body scans and testing sessions throughout the challenge.
b) Provide a written post challenge testimonial (structure to be provided in challenge guidelines)
c) Provide such proof of identity and/or the validity of the winning eligible entry, and sign such consents, releases or other terms and conditions applicable to Y NSW Centres, as the Promoter reasonably requires.
26. If more than one person attempts to claim the prize, the Promoter has sole and absolute discretion to determine which of those persons the winning entrant is.
27. The winner hereby consents to provide a testimonial and allow for the Y NSW to take photos or recordings of them (and contacting you for those purposes).
28. The Y NSW will be granted permission to use any of the comments, photos or recordings obtained from you, your name, and/or likeness (the Materials) for the Promoter's and/or, with the Promoter's consent (including consent subject to any conditions), the Participating Centre’s, future promotional and marketing purposes without further reference or compensation. This excludes content from within the closed Facebook group.
29. Participants grant to the Promoter a royalty free, perpetual, non-exclusive and irrevocable licence to use the Materials for whatever purpose the Promoter determines; and
30. Where the Promoter consents, you grant to the Participating Centre, a royalty free, perpetual, non-exclusive and irrevocable licence to use the Materials for whatever purpose the Promoter consents to.
31. Eligible Entrants agree and acknowledge that all entries and any intellectual property rights subsisting in their entries become and remain the property of the Promoter.
32. Each entrant acknowledges and agrees that it is a condition of participation in the Promotion that the entrant be capable of agreeing to these Promotion Terms and giving the consents contained herein.
